Planetary Profits - Terms and Conditions

By downloading, installing, or using the Planetary Profits mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Techfusion Pvt. Ltd. By using the App, you also acknowledge that you have read and understood our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms and our Privacy Policy, you may not use the App.

2. Use of the App

• License: We grant you a limited, non-exclusive, revocable, non-transferable license to download, install, and use the App on your mobile device for your personal, non-commercial use, subject to these Terms.
• Account: You may need to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Age Restriction: You must be at least [Specify Age, e.g., 18] years old to use the App. By using the App, you represent and warrant that you meet this age requirement and are competent to contract within the meaning of the Indian Contract Act, 1872. If you are under [Specify Age], your use of the App must be supervised by a parent or legal guardian who agrees to these Terms.
• Prohibited Conduct: You agree not to:
  • Use the App for any illegal or unauthorized purpose.
  • Interfere with or disrupt the operation of the App.
  • Attempt to gain unauthorized access to the App or our systems.
  • Use any automated means to access the App.
  • Violate any applicable laws or regulations.
• Consent to Data Collection: By using the App and providing us with your personal information, you consent to the collection, storage, processing, disclosure, and transfer of your personal information as described in our Privacy Policy.

3. Disclaimer of Astrological Information

IMPORTANT: PLEASE READ CAREFULLY.

The information provided through the Planetary Profits App is based on astrological interpretations and is for informational and educational purposes only. It should NOT be considered as financial advice or a substitute for professional financial consultation.

We strongly recommend that you consult with a qualified financial advisor before making any investment decisions. The astrological suggestions provided within the App are based on the astrological data you provide and are subject to interpretation.

We are in a learning phase, and the astrological interpretations and investment suggestions provided by the App may not be accurate or suitable for your specific financial situation. You acknowledge and agree that any reliance on the information provided through the App is at your sole risk.

We are not responsible for any financial losses or damages you may incur as a result of using or relying on the information provided through the App.

4. Payment and Credits

• Credit Points: The App utilizes a credit point system to access certain features, such as communication with our astrology tool.
• Purchase of Credits: You can purchase credit points through the payment methods offered by the Google Play Store or Apple App Store. All payment processing is handled by RevenueCat, and your use of their services is subject to their terms and conditions and privacy policies. We are not responsible for the practices of RevenueCat.
• No Refunds: Due to the nature of the service (providing access to communication with an astrology tool), we currently do not offer refunds for purchased credit points.
• Credit Usage: Each conversation with the astrology tool consumes one credit point.
• No Expiry: Purchased credit points do not have an expiry date.
• Taxes: All prices are inclusive of applicable taxes.

5. Third-Party Services

The App relies on third-party services, including but not limited to:

• Google Sign-in/Apple Sign-in: For account authentication. Your use of these services is subject to their respective terms and privacy policies.
• RevenueCat: For payment processing. As mentioned in Section 4, their terms and privacy policies apply.
• Third-Party Astrology Provider: We use a third-party service to obtain astrological data. Your interaction with the App involves the transfer of your Astrological Information to this provider as described in our Privacy Policy. We are not responsible for the practices of this third-party provider beyond our contractual obligations to protect your data.

6. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, and software, are owned by or licensed to us and are protected by copyright, trademarks, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based on the App or its content without our prior written consent.

7. Termination

We may terminate your access to the App at any time, with or without cause, including if you violate these Terms.

8. Disclaimer of Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TECHFUSION PVT. LTD. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR ACCESSING THE APP.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

11. Changes to these Terms

Techfusion Pvt. Ltd. reserves the right to change or remove any part of these Terms at any time. We will notify you of any significant changes by posting the new Terms within the App or by other means. We encourage you to review these Terms periodically for any changes. Your continued use of the App after the posting of revised Terms constitutes your acceptance of the changes.
